Prenup Laws by State

On this page, you’ll find summary information about each state’s particular prenup laws.

Alabama Prenup

Antenuptial agreements are permitted in Alabama under code section 30-4-9, which permits a husband and wife to enter into a contract with each other.

Alaska Prenup

In Alaska, prenuptial agreements are permitted.

Arizona Prenup

According to Arizona Revised Statutes, section 25-201, “Premarital agreement” means an agreement between prospective spouses that is made in contemplation of marriage and that is effective on marriage.

Arkansas Prenup

In Arkansas, Title 9, Subtitle 2, Chapter 11, Subchapter 4 is the Arkansas Premarital Agreement Act, which goes into great detail about how premarital agreements work in Arkansas.

California Prenup

The California Family Code deals with premarital agreements in sections 1610 – 1617.

Colorado Prenup

In Colorado, you can find the Uniform Premarital and Marital Agreements Act at Title 14, Part 3 (Act is in frames, so you need to click through to the appropriate section).

Connecticut Prenup

The Connecticut Premarital Agreement Act is found at Sec. 46b-36a of the Connecticut General Statutes.

Delaware Prenup

In Delaware, Title 13, Chapter 3, Subchapter 2 deal with premarital agreements.

District of Columbia Prenup

Premarital Agreement is defined in the District of Columbia’s Code at section 46-501 to be “an agreement between prospective spouses or prospective domestic partners made in contemplation of marriage or domestic partnership and to be effective upon marriage or domestic partnership.”

Florida Prenup

In Florida, premarital agreements are deal with at Title 6, Chapter 61.

Mississippi Prenup
